Job Description:

The opportunity

In this challenging position, you will provide professional risk and contract management advice and guidance to Sales, Procurement and Project management teams. You will be responsible for developing risk and contract management strategies for ensuring improved operational results within the Hub. You will also support process improvements throughout the organization in matters of risk, and contract management. 

You will provide Contract management services for select large and complex projects in the Hub Business Unit, ensuring contract management activities are executed in accordance with the relevant Group directives & BU instructions  

 

You will protect Hitachi Energy business interests from tender submission to project completion ensuring that all contract and risk management activities are executed in accordance with all directives and instructions as well as timely and accurate execution of contractual aspects of the projects, such as claims, variations, warranties, etc. 

How you’ll make an impact

Tender Risk Management

  • Prepare and update periodically the Hub Risk Management instruction and governance. Specifically adapt to the respective local conditions when and where necessary and ensure consistency with the Group directives and Business Unit Risk Management instructions.
  • Drive and manage professional Risk Review process during tendering phase laying a good foundation for the same during execution phase by participation in Local/Hub/Group risk review meetings.
  • Ensure that group Risk Management directives, instructions, guidelines and governance process is communicated to all the stake holders both for the Tender Risk Management and Project Risk Management.
  • Ensure effective risk mitigation by appropriate actions in the tendering phase itself for eg. sound cash-flows by ensuring that the tendering teams negotiate appropriate payment terms.

Project Risk Management

  • Prepare and update periodically the Hub Project Risk Management instructions and governance process for the individual countries in the Hub, specifically adapt instructions to the respective local conditions where and when required while ensuring consistency with the Group directives.
  • Actively participate in select Project Reviews and advise the team from a commercial, contractual and risk management perspective leading to Risk and Opportunity Assessment.
  • Ensure development and implementation of a risk mitigation and opportunity plan in cooperation with Project Management ensuring margin improvements during project execution and preventing margin erosion.
  • Ensure appropriate evidences are maintained in a transparent way complying with the Internal Controls duirng the tendering and execution phases.
  • Interface with other Hitachi Energy corporate functions viz. legal, tax, accounting. Develop and implement strategies for mitigating the risks in the legal and taxation areas by conducting focused trainings to the stake holders.
  • Interface with Group, Business, Hub Business Unit Management as required in matters pertaining to risk management.

Common (Tender and Project Risk Management)

  • Develop Risk Management competence in Sales teams and execution teams (PMs) by conducting pragmatic trainings periodically with specific and relevant content, custom made for the particular business, periodically updating the content to make it relevant and current.
  • Optimize the internal workflow, procedures and processes so as to maximize the value of the time spent in Risk Management function by the stake holders, encouraging it to be a process in true spirit of Risk Management rather than a mere compliance exercise.

Contract Management

  • Ensure contract management activities are executed in accordance with Group Directives / BU &  Hub Instructions.
  • Liaise with local contract management, legal and tendering teams to promote best-in-class samples, standards and lessons learned.
  • Provide guidance and instructions to local teams to manage change due to new customer requirements (Datacenters uptime requests, engineer dispatch deadlines etc)
  • Provide hands-on support to local PM and Tendering teams in case local CM and Legal support is not available for select large and complex tenders.
  • Review, comment and negotiate (if required by the Sales team) the contractual tender terms and conditions considering risk, pricing, scope and schedule.
  • Discuss and align requirements and necessities with legal and local contract teams.
  • Ensure contract and claims strategies are prepared, monitored and followed in full coordination with the relevant Project Manager.
  • Enforce and defend Hitachi Energy contractual rights and obligations throughout the project lifecycle.
  • Provide guidance and leadership on contract management related matters to cross-department business team members.
  • Actively participate in claim negotiations.
  • Work in close collaboration with Legal department to ensure accurate handling of all export control matters, in addition to reviewing contracts/projects regarding export restrictions.
  • Provide professional support where required regarding purchasing activities ensuring flow down of customer terms and conditions to the sub-vendors.
  • Discuss and align resource requirements and necessities with legal and local contract teams.
Your background
  • Bachelor or Master’s degree in Law preferred, alternatively degree in business administration or engineering with strong and relevant legal /contractual experience.
  • At least 8 years of experience in Risk and Contract Management including strong knowledge of service agreements, engineering or procurement environments.
  • Proven track record of handling projects of varying size and complexity.
  • Experience in drafting different types of contracts: sub-supplier, consortium etc.
  • High-level negotiations: contract administration, claims, change management and sound knowledge of planning and scheduling.
  • Ability to resolve disputes and manage dispute resolution in cooperation with Legal department.
  • Solid understanding of change management, claim management and contract related legal issues during both tender and project phases.‑related legal issues during both tender and project phases.
  • Understanding of project planning analysis as well as business acumen, integrity, result oriented approach and problem-solving skills.
  • Excellent command of English, both written and spoken. German is an advantage.
  • Site based experience and technical knowledge of electrical products is an added advantage.
