Key Responsibilities & Accountabilities:
Overall responsibility for leading the CASS Function providing guidance and oversight on the firms responsibilities under the FCA, CASS and PSR regulations.
Regulatory Compliance and Oversight:
• Ensure full compliance with the Client Asset Sourcebook (CASS) regulations as defined by the FCA.
• Responsible for interpreting and implementing CASS requirements across the
organisation.
• Develop and maintain policies, procedures, and controls to safeguard client
assets
CASS Governance:
- Develop the firm’s CASS governance framework, ensuring robust oversight and
adherence to regulatory standards.
- Conduct regular CASS Committee meetings, presenting updates, risks, and key
findings to senior management.
- Reconciliation and Reporting:
- Oversee daily reconciliations of client money to ensure accurate records and
compliance.
- Submit timely and accurate CASS reports to regulators, auditors, and internal
stakeholders.
Risk Management:
- Identify, assess, and mitigate risks related to client asset protection, ensuring
the firm’s processes minimize potential breaches.
- Lead the resolution of any CASS-related breaches or incidents, including root
cause analysis and implementing corrective measures.
Internal and External Relationships:
- Liaise with internal teams such as Compliance, Operations, Risk and Legal to
align CASS processes with broader organisational goals.
- Act as the primary point of contact for external auditors, regulators, and other
stakeholders on all CASS-related matters.
Team Leadership and Training:
- Lead a team responsible for CASS compliance, offering guidance and support to ensure operational excellence.
- Provide training and education to staff across the organisation on CASS
principles.
Strategic Development:
- Monitor regulatory developments and emerging trends in CASS regulations,
advising the organisation on potential impacts.
- Contribute to shaping the firm’s strategic approach to client asset management in a dynamic regulatory environment.
- Ensure timely reporting of any CASS breaches to the FCA and other relevant
parties, as required by regulatory obligations.
- Escalate significant risks or compliance issues to the Board and senior
leadership with appropriate recommendations.
FCA Certification
The role holder will be an FCA authorised employee, requiring certification by Monex forthe client dealing function under the SMCR.
The individual carries personalaccountability for their area of responsibility in accordance with section 63E(1) FSMA 2000.
The Company is required to certify annually that the individual is, and remains, fit and proper, and competent to carry out their duties; to manage and act as first line of defence for all appropriate risk, compliance and operational controls affecting the business area, ensure compliance of their activities with rules and regulations, asking the Compliance Department for advice where necessary.
The holder of the role will be assessed for certification both at commencement and thereafter on a continuous basis. To continue in the role, the individual will need to meet and continue to demonstrate fitness and propriety, competence and capability.
The holder of this role is subject to first tier conduct rules.
